Why Is Sarah Palin Paying Hundreds of Thousands If She Isn't Hiding Something?

Why Is This Idea Important?: Legal comparisons with birfer arguments

http://www.foxnews.com/politics/2009/06/21/palin-spars-critics-ethics-complaints/

By her own admission, Sarah Palin has paid half a million dollars to fend off frivolous ethics complaints. If she isn't awash in ethical crimes, why doesn't she just admit her ethics shortcomings and this will all go away?

Because she CAN'T.

(Does this argument sound familiar, birfers?)

  1. JordanKJjordan!! Why would you vote against this? I'm just trying to get to the bottom of Sarah's ethical malfeasance!!! It's positively un-American they way she is stonewalling about her crimes against the State of Alaska. Clearly, the governor is a Muslim whose intent is to violate the American Constitution.

Why else would she be paying all these lawyers to ward off these lawsuits, lawsuits that are simply seeking disclosure?

She must be hiding something. Her actions are taking us down the path to Communism.

    Palin cleared in ethics probe

"The Alaska Personnel Board report, issued on the eve of the U.S. presidential election, ran contrary to findings from a legislative inquiry that concluded in October that Palin had abused the power of her office by pressuring subordinates to fire a state trooper involved in a feud with her family."

Does that make her corrupt? She didn't keep the clothes. The RNC took them back. Sarah also charged the state of Alaska for working from home. I work from home. I do more work from home than I did when I worked from the office. Why shouldn't she charge them for that?

This thread is just birfer snark. I'm using the same idiot arguments the birfers use against Obama. When Obama is the target, it makes sense to them. When Palin is the target, it doesn't make sense.

Sarah Palin is a genuine ethics reformer, so they are trying to destroy her with frivolous ethics complaints.

    April 29, 2009 · 2 Comments

Sarah is like Reagan, whose son described him as a guy “who always thinks the best of people” and can’t imagine that they would stab him in the back. Neither can Sarah Palin.

She has spent less in personal expenses than her predecessors. She has managed the state budget more responsibly. She put an end to backroom deal-making with oil producers and initiated an open and transparent process for negotiating a fair return on Alaska’s resources and developing a natural gas pipeline that is not beholden to any monopoly interest. She wanted them to hold her accountable because she knew that she could meet any fair final accounting.

But she didn’t anticipate the base motives of vindictive evil people. Yes, it is evil to try to bankrupt a family, to smear their names, to chase an honest reformer out of office. Read More

    Latest Complaint Deemed Outrageous

The Office of the Governor today expressed outrage that yet another baseless ethics complaint has been filed as part of an alarming new development in Alaska politics.

“These allegations are categorically false and ridiculous, and are an abuse of the Executive Ethics Act,” Nizich said.

“We are blessed to live in a democracy in which everyone has the right to free speech, to petition their lawmakers, to vote, to run for office and, yes, to allege misconduct by public officials,” said Bill McAllister, the governor’s communications director. “But obviously the purpose of this complaint and the previous ones is to distract the administration and the public, and to paralyze the Department of Law and the executive branch.

“There’s a core hypocrisy in nearly all of the ethics complaints brought against the governor, including this one. The ethics act clearly states that complaints, when filed, are to be confidential. Ms. Tompkins publicized her filing on several blogs, breaking the letter and the spirit of the law. While there are no penalties in the statute for this illegal behavior, Alaskans of all political persuasions should be appalled that the people who are alleging unethical behavior by the governor are repeatedly doing so unethically.”

The relevant section of the ethics act follows:

“Sec. 39.52.340. Confidentiality. (a) Except as provided in AS 39.52.335, before the initiation of formal proceedings under AS 39.52.350, the complaint and all other documents and information regarding an investigation conducted under this chapter or obtained by the attorney general during the investigation are confidential and not subject to inspection by the public. In the case of a complaint concerning the governor, lieutenant governor, or attorney general, all meetings of the personnel board concerning the complaint and investigation before the determination of probable cause are closed to the public. … The attorney general and all persons contacted during the course of an investigation shall maintain confidentiality regarding the existence of the investigation.” Keep reading

Contrast this with Obama's answers to birfer lawsuits. He only files for dismissals. Lately he's been asking for damages--and winning. Recently a judge calculated Obama's damages at $520. That's how much he's spending to file for each dismissal.

  32. Democracy:

    A government of the masses.

Authority derived through mass meeting or any other form of "direct" expression.

    Results in mobocracy.

Attitude toward property is comunistic-negating property rights.

Attitude toward law is that the will of the majority shall regulate. whether it be based upon deliberation or governed by passion, prejudice, and impulse, without restraint or regard to consequences.

Results in demagogism license, agitation, discontent, anarchy.

Democracy is the "direct" rule of the people and has been repeatedly tried without success.

A certain Professor Alexander Fraser Tytler, nearly two centuries ago, had this to say about Democracy: " A Democracy cannot exist as a permanent form of Government. It can only exist until the voters discover they can vote themselves largess out of public treasury. From that moment on the majority always votes for the candidate promising the most benefits from the public treasury with the result that Democracy always collapses over a loose fiscal policy, always to be followed by a Dictatorship."

A democracy is majority rule and is destructive of liberty because there is no law to prevent the majority from trampling on individual rights. Whatever the majority says goes! A lynch mob is an example of pure democracy in action. There is only one dissenting vote, and that is cast by the person at the end of the rope.

    Republic:

Authority is derived through the election by the people of public officials best fitted to represent them.

Attitude toward property is respect for laws and individual rights, and a sensible economic procedure.

Attitude toward law is the administration of justice in accord with fixed principles and established evidence, with a strict regard to consequences.

A greater number of citizens and extent of territory may be brought within its compass.

Avoids the dangerous extreme of either tyranny or mobocracy. Results in statesmanship, liberty, reason, justice, contentment, and progress.

Is the "standard form" of government throughout the world.

A republic is a form of government under a constitution which provides for the election of:

    an executive and

a legislative body, who working together in a representative capacity, have all the power of appointment, all power of legislation all power to raise revenue and appropriate expenditures, and are required to create

a judiciary to pass upon the justice and legality of their governmental acts and to recognize

    certain inherent individual rights.

Take away any one or more of those four elements and you are drifting into autocracy. Add one or more to those four elements and you are drifting into democracy.

Our Constitutional fathers, familiar with the strength and weakness of both autocracy and democracy, with fixed principles definitely in mind, defined a representative republican form of government. They "made a very marked distinction between a republic and a democracy and said repeatedly and emphatically that they had founded a republic."

A republic is a government of law under a Constitution. The Constitution holds the government in check and prevents the majority (acting through their government) from violating the rights of the individual. Under this system of government a lynch mob is illegal. The suspected criminal cannot be denied his right to a fair trial even if a majority of the citizenry demands otherwise.

Difference between Democracy and Republic, in brief:

    Democracy:

a: government by the people; especially : rule of the majority.

b: a government in which the supreme power is vested in the people and exercised by them directly or indirectly through a system of representation usually involving periodically held free elections.

Attitude toward law is that the will of the majority shall regulate, whether it be based upon deliberation or governed by passion, prejudice, and impulse, without restraint or regard to consequences

    Republic

a: a government having a chief of state who is not a monarch and who in modern times is usually a president : a political unit (as a nation) having such a form of government.

b: a government in which supreme power resides in a body of citizens entitled to vote and is exercised by elected officers and representatives responsible to them and governing according to law.

Democracy and Republic are often taken as one of the same thing, but there is a fundamental difference. Whilst in both cases the government is elected by the people, in Democracy the majority rules according to their whims, whilst in the Republic the Government rule according to law. This law is framed in the Constitution to limit the power of Government and ensuring some rights and protection to Minorities and individuals.

The difference between Republic and Righteous Republic is that in the Republic the Government rules according to the law set up by men, in the Righteous Republic the law is the Law of God. Only in the Righteous Republic it can truly be said "One nation under God" for it is governed under commandments of the only One True God and there is no pluralism of religions.

Autocracy declares the divine right of kings; its authority can not be questioned; its powers are arbitrarily or unjustly administered.

Mobocracy: 1. Political control by a mob. 2. The mass of common people as the source of political control.

Black, you are comparing apples and oranges here. You're trying to justify Obama's spending whatever money he's spending trying to hide his birth certificate AND his school records by saying, "What is Palin trying to hide because she's spending money on attorneys."

Here's the difference: Obama is spending money to hide the fact that he's not met the criteria for his position and also he's spending money because he doesn't want anyone to know what's in his school records, for whatever reason. (As an aside, this is the man who promised transparency in government....except for him.) I have my speculations on why he doesn't want his school records exposed.

Palin, on the other hand, is spending money to avoid losing lawsuits and ethics investigations by default, by not answering to allegations.

I look at the lawsuits thrown at Palin as a badge of honor on her behalf. Anyone who blows the whistle on as many politicians who were doing unethical things in Alaska is, of course, going to get this type of backlash. They are, of course, going to make sure that she pays dearly. This is their only recourse.

I was in government for 25 years. I know this is how the paybacks work. So everytime I hear of Palin getting ANOTHER lawsuit thrown at her AND it gets thrown out or the results are unfounded, I know that she really went after the big politicians and ruffled a LOT of feathers. That's the person I want handling taxpayer money. All the other politicians appear to be running on a greed mode and filling their pockets.

This is a typical leftie reverse logic statement they are so fond of using. They cannot defend their own, so they either (1) smear the opposition they fear the most (Palin and Rush for example) or turn around any valid complaint against those on the left, as if it instead somehow applies to the accuser. It is the kind of logic we used on the elementary school playground, and it just tires me to see it again and again. The left is scared sh&*less of Sarah Palin, combined with the free opportunity in Alaska to throw out ethics complaints, makes it easy for them and just unfair for the accused. They have thus far all been thrown out. Alaska needs to rethink their policies and make it cost more to make false accusations. Like jail time.

  70. kichman,

Like most right wingers, you're wrong. The accusations against Palin are immaterial. I DON'T CARE.

I worded the post so that it sounds exactly like the repetitive idiot accusation that OBAMA must be hiding something because he pays his lawyers hundreds of thousands of dollars. Right wingers accept Obama's guilt-by-lawyer's-fees offense. But the same principle isn't true of Sarah Palin.

It's not the left's hypocrisy that is on trial here.

Obama IS hiding something. Nobody, I mean NOBODY goes to such lengths to seal their own birth and college records. Don't distract that fact, from the previous statement regarding Obama's overall costs for attorneys. They all spend money on attorneys. Bush and all of them. But nobody I can recall has spent money on attorneys sealing personal information that is not only required to even be considered for POTUS position, but is deemed public knowledge once such office is attained.

Well to answer your post regarding the difference, between Palin and Obama is simple. Palin has actually been investigated

by the legal system for each and every complaint, and found innocent. But found guilty by the media and all those idiots who believe everything the MSM dishes out. Obama's birth certificate issue, despite being a big thing for the lefties back during the election with John McCain, got big press by the MSM. But now that the shoe is on the other foot, after those responsible to ensure laws were followed fell in love with their messiah, the MSM is completely reluctant to give any press to the issue, despite that it is 10 times bigger issue now that the office is filled, likely by a foreigner. They cannot even get billboard coverage by the big companies, CBS and the others despite our "freedom of expression" and "free press". States' attorneys general and federal judges are either looking out for themselves or looking for federal posts, and overlooking these complaints, despite their obvious merit. The supreme court has one suit now that may take hold, it awaits response from the defense, under time extension due a few weeks from now. Likely they will extend and extend till 8 years is up.

Remind me again how free we are.

  76. kichman,

You must be new here. Point out the law he is breaking by sealing his records or, more succinctly, asserting his right to privacy. The laws are in his favor. Prior presidents released their records. Fine. No law said they had to. This president chooses not to release his records. Fine. No law says he has to.

I have pointed this out repeatedly. He is not violating any law in any state by asserting his right to privacy. CarpentAnt and rejean and the rest of the short bus crew know this. And yet they scream and holler as if his assertion of his basic rights as a citizen is somehow sinister.

No one is listening to these tards. Not even the kings of tards, Limbaugh and Hannity, give this story any credence. What does that mean to CarpenterAnt? "They must be in on the conspiracy."

You can't reason with retards. You can only insult them.
