Dear Senator Byrd,
In response to your letter of January 7, 2009, I am appalled by your ignorance regarding the Obama "natural born citizen" issue. You are the senior member of our Senate and of all 548 members of our government in Washington, D.C., you should be the most knowledgeable of our Constitution and its requirements. Regardless of where Obama was born, by all reported statements of fact, including Obama's own website, his father was a student from Kenya here on visa, not a US resident or citizen, and was a British citizen. His mother was an eighteen year old who under US law in 1961, could not pass citizenship to her child unless she was a US resident five years past the age of sixteen. The natural born provision of our Constitution protects our country from having the office of our President and Vice-President being held by a foreign usurper. By this, I am not accusing Obama of being a usurper. He, most likely, just happened to fall into this ineligibility situation by his circumstances; as have many other good citizens of our country. As I'm sure you must know, sometimes our laws result in unpleasant consequences for a few in order to provide for the good of the many. This is the case with the natural born provision. It appears to me that you need to review the acts of the 1st Congress, specifically the words of John Jay, our first Chief Justice of the Supreme Court, to familiarize yourself with the natural born provision of Article II of our Constitution and why it is there. Under modern thinking, can you imagine that Prince William of Great Britain could have visited our country and seduced a young woman and produced a child which he could then have provided the financial means to cause him to be elected to the highest office in our land and perhaps the most powerful position in the world. When he becomes King William, he would have a blood alliance between Great Britain and United States? Who did we fight for our independence? Why would we want to take a chance on going back?
Under the Freedom of Information Act, I am requesting that you inform me and provide documentation as to who or what agency is responsible for insuring that a person who places their name upon our election ballot for the office of President or Vice-President meets the "natural born" qualification of Article II of our Constitution.
I've seen many instances of Congress winking at our Constitution but this is the most dangerous and has aroused me to do all I can to bring it to the attention of those who are in a position to protect us from a Constitutional crisis.
As to the birth certificate issue, you enclosed a December 8, 2008 AP press release which clearly distorts the truth. This is a perfect example of the confusion caused by the mainstream media being paid to disseminate misinformation to the public. It explains to me how this situation has gotten so out of hand. The press release contains these words which you believe to be true:
"Hawaii Health Department Director Dr. Chiyome Fukino and the state's registrar of vital statistics, Alvin Onaka, say they checked health department records and have determined there is no doubt Obama was born in Hawaii."
This is an outright lie. I wrote to the governor of Hawaii. Her office sent me a link to the press release which stated:
"Therefore, I as Director of Health for the State of Hawai'i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai'i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures."

No where in this document does it state where Obama was born. Apparently you have not educated yourself on the fact that Hawaii allowed family members of/or residents to register a birth that took place outside their state within descriptions set by their law. There are some competent attorneys who think it is highly possible that this was done by Obama's mother or grandparents. When the Obama campaign refused to release his birth certificate to reporters, the public began to suspect he may not have been born in the United States. The Certificate of Live Birth which Obama released does not state the location or hospital of birth or any name of any attending doctor or midwife or any witnesses at all. It could very well be a copy provided as certification that he has a birth recorded in Hawaii and that birth could have by their law taken place outside the state. Many legal challenges are in the works. The Supreme Court still has more than one on their docket for consideration. I believe that before this issue is resolved, many of our "leaders" will be wiping egg off their faces. This will signal the end of a mainstream media already in serious trouble. I believe this will be for the good of the citizens of the US and the entire world and may be the reason God has allowed this situation to evolve.
The press release you sent me also included other statements which I beg to differ with but for the sake of brevity will not include here. The statements below are taken from the only public sources I can find as to Obama's birth. There are two public sources for two different birth sites, neither of which has been confirmed. His sister has, likewise, cited these same two different sources in two different interviews several years apart. This can only be confirmed by Obama himself and he has refused. I might add he has spent an enormous amount of money in refusing when he could just state publicly where he was born and give permission for Hawaii officials to provide confirmation as their law allows. This would settle the birth certificate issue for me and most folks without seeing the vault certificate.

Traditionally, a presidential birthplace becomes a historic landmark. I find it unbelievable that in our modern times, we have no way to prove this historical fact for President-elect Obama. No one will even ask him to state his place of birth publicly.
Genealogy is my hobby. Until a few years ago, when younger politicians convinced our lawmakers to hide and destroy public records in the name of privacy, I was able to confirm vital records from the present back to early 1600’s. In the last few years, I have found myself blocked from important research information by new laws. This is a very dangerous situation and needs to be addressed. All vital records should be public. Study the history of why we collected this information and why it is so important for all of us.
It is my hope and prayer that you or someone will stand up and see to it that this issue is resolved before it leads to civil unrest and possibly the end of our constitutional government. Our government, based upon constitutional law, has endured and been a shining example to the world for over 230 years. I pray God's blessing for it to continue.

What did Senator Byrd actually say in his letter of January 7, 2009?
The letter read:
Thank you for contacting my office about President Obama's citizenship. I appreciate your providing me with the benefit of your thinking on this matter.
As you may be aware, the U.S. Supreme Court has declined to review Donofrio v. Wells. With the thought you might find it of interest, I have enclosed a recent article on the Supreme Court's decision. I hope this information is useful to you.
Article III of the Constitution vests all power to decide specific cases and controversies in the courts, and no Member of Congress is charged with the power to render judicial opinions. It is the duty of the courts, and the courts alone, to determine whether laws have been violated and what remedies should be provided for such violations. Likewise, this power affords any defendant the opportunity to call witnesses and provide evidence in his defense. To offer a definitive answer to this question would not only overstep the boundaries of the Constitution, but it would also deny a Constitutional right granted both to the Judicial branch and any defendant facing prosecution. I hope I have your understanding in this matter.
While your question in this matter is outside my authority, perhaps there will be a future matter coming within the province of my office in which I might be of service to you.

Apparently aides are answering his mail because shortly after this I received another letter from him with a completely different response placing the responsibility upon each state instead of the Supreme Court.
Dear Mrs. ,
Thank you for contacting me to express your concerns about the eligibility requirements of individuals who run for office.
While it is always my wish to assist my constituents, I must advise this is a state matter over which I have no authority as a U.S. Senator. The eligibility requirements for candidates to run for office are set by the Secretary of State of each individual state. (My Note: Address of WV Sec of State was inserted here.)
I sent them a copy of Byrd's letter and asked for a copy of the application signed by Obama. Even though they had ignored my prior requests, they very quickly sent me a photocopy of the (WV Code 3-5-7) Certificate of Application Obama signed. It stated, "I swear and affirm that I am a candidate for this office in good faith and I am eligible and qualified to hold this office. Candidate's signature line had the signature of Barack Obama and date 12/07/07

The state of Hawaii provided copies stating that Hawaii Revised Statutes 11-113 (Presidential Ballots) provides that a recognized political party will provide
(1) the names and addresses of its candidates (2) a statement by the political party that each candidate is legally qualified to serve under the provisions of the U.S. Constitution and (3) a statement that the candidates are the duly chosen candidates of both the state and the national party. A party that provides this information for its candidate for President and Vice-President of the United States secures its candidate's place on the ballot.
Hawaii also provided a copy of the official certifications of nomination from the Democratic Party of the United States and the Democratic Party of Hawaii stating that their nominees were legally qualified to serve under the provisions of the United States Constitution.
The documents carried the signatures of:
Nancy Pelosi, Chair and Alice Travis Germond, Secretary and Joseph Sandler, General Counsel for Democratic National Committee
and state forms carried the signatures of :
Brian Schatz, Chair and Lynne Matusow, Secretary
Where's the real birth certificate??
Most Americans know what one looks like. The one on the internet is not the one we want to see. It is a fraud. Obviously, he was born in Kenya, as his Grandmother said, not the USA.
