An Amendment to the Constitution of the United States

Section 1. THE SIXTEENTH ARTICLE OF AMENDMENT OT THE CONSTITUTION OF THE UNITED STATES IS HEREBY REPEALED.

Section 2. The Congress shall have Power To lay and collect Taxes on incomes, without apportionment among the several States.

Section 3. No capitation, or other direct, Tax shall be laid, unless equal and in Proportion to the Census or Enumeration herein before directed to be taken.

COMPARE WITH THE PRESENT 16TH AMENDMENT:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived without apportionment among the several States and without regard to any census or enumeration. Amendment 16.

You will note I dropped the two following phrases from the 16th Amendment “From whatever source derived. . . “ was interpreted by the IRS to include world wide income. If you earned money anywhere in the world you have to pay taxes on it.

"Without regard to any census or enumeration" . . . gave the IRS the legal ability to tax us without a census, but the Constitution had required the census specifically for the tax. Therefore, the 16th Amendment became quite odious and it wasn't even ratified properly. That's been known for years, but a lot of people have gone to jail who used that as an argument to not pay. So, GOING BACK TO THE CONSTITUTION, Article 1. Section 8, BY REPEALING the 16th Amendment, would mean that the census would ONLY BE USED FOR counting the people and their ages. It could be used for no other purpose, because no other purpose is provided.

In final analysis of my proposal, Sections 2 and 3 are merely restatements of Article 1. Section 8, the first and last clauses of the same. Let's RESTORE the Constitution of the United States. Article 1, Section 8 is still there. Let's use it.

Why Is This Idea Important?

Require Congress to obey the forefather's MANDATE. Federal taxes were to be very, very low. When Congress started spending more and more money due to all the buildings they were building in Washington, the wolves in sheep's clothing introduced the 2nd and 5th planks of the Communist Manifesto by starting a "heavy progressive method of income taxation." The Federal Reserve Bank was also created in 1913. IF we are to be a FREE people, we MUST repeal the 16th Amendment.

A Ferrel Sales Tax would mean we would pay thousands of dollars a year more than would be necessary. By REPEALING the 16th Amendment that gave us all the mess we're living with today, the Federal government would take the sum total of their expenses and divide them equally amongst the total number of tax payers. Honest taxes free from Socialism would require a payment of a couple hundred dollars per person per year instead of thousands!

A Flat Tax would allow the Ferrel Government the opportunity to set the tax rates to whatever percentage the American people would stand without too much hissing. Jean Baptiste Colbert said: “The art of taxation consists in so plucking the goose as to obtain the largest possible amount of feathers with the smallest possible amount of hissing.” So, a flat tax is no good because the members of Congress can't be trusted.

Just the right way to tax is to make every tax payer pay equally the same. And by the way, even God said so in Exodus 30:15. The rich were NOT to pay more and the poor were not to pay less.

The 16th. Amendment is a misunderstood issue promoted by individuals who exploit the tax deniers.

The Amendment has never applied to a tax on wages; it has only applied to a tax on ‘’gain’ from capital investments. Read Pollock.

The Brushaber and later SC opinions repeatedly stated the Amendment was to reverse the holding of the Pollock court. Pollock, in the original and on the rehearing, specifically stated a tax on wages or remuneration for labor was NOT an issue before the court. The tax levied on gain from capital investments was HELD unconstitutional. The remainder of the tax litigation, including the tax on wages/remuneration was voided. The tax on wages could have been reinstated by Congress by legislation.

The SC overruled Pollock in South Carolina v Baker, 485 US 505 (1988). The Amendment is effectively null and void. It has never been used as a source of tax authority in any process filed in a court on behalf of the IRS. The Amendment is a dead issue regardless of Bill Benson.

Liberty, I may be inclined to believe you, but the Courts have uniformly disagreed. People are regularly sent to jail for these legal arguments. REPEAL the stupid law and those problems all go away. This amendment would allow zero deductions. You wouldn't need them. Everyone would pay a couple hundred bucks and it would be finished. The law would be all of a couple of pages long.

It never was legaly ratified in the first place. Tax is theft its immoral and it is only a debt slave control mechanism. The federal reserve Rothschild crominal bank creates money from thin air instead of our government creating it why the hell does our government have to borrow this fiat newly created money from this phony fake bank and create a bogus debt plus intrest.. why does our government think we have to pay this debt plus intrest why do most people think its ok for the government to steal from us ie tax they think this theft money is to help the poor or roads or educate the children what a huge lie its only to pay the phony debt to the rothschild controled Rockerfeller run Federal Reserve Private bank. Stop the theives we are not debt slaves.

Hi Pure,

I agree with you, but the Supreme Court of the United States disagrees with both of us. Do you have any idea how many lives have been ruined due to the SCOUS and the inferior court rulings?

You raise a fine point of the Ferrel Reserve Banksters too, but again, we are looking at an UN Constitutional government that we did not bind down by the chains of the Constitution. That was our fault. But it gives them no license to ignore what they affirm by oath.

You will note I also have a post for getting rid of the Ferrel Reserve Banksters. Both the 16th Amendment and the FRB must go before we'll be able to be free again.

The supreme court is bogus, when a justice is a member of the NEW WORLE ORDER counsel on forign relations David Rockerfeller hand picks the members. when a supreme court justice is appointed by a president who was installed by the ROthschild owned Rockerfeller run criminal bank cartel these are sold out slaves not judges they do not matter. They will do as they want. We have to decide that this is not what we want we have to end the debt slavery one person at a time we have to reject this theft and this slavery. They create money they create debt they own every and anything except our individual decissions.

I've been predicting your appearances since 1975. I have written elsewhere that it was since 1968. I was corrected. It was since 1975. First a liar becomes a theif then the theif becomes a murderer. They will never stop on thier own, they see us as sub human, weak, they see us as overpopulated cockroaches they see theselves as gods as higher and better why or what would ever make them stop on thier own. Heck they even think they can live forever, why are they so into eugeniics? I reject them and everyone and anyone or anything they have touched. They are Rothschild and every sold out human that goes along with them.
