Prevent Patents of Living Things

Why Is This Idea Important?: The patenting of seeds and plants creates destructive monopolies that take advantage of poor communities in developing countries as well as many small farmers in this one. Patents on seeds are a major way in which multinational Agribusiness companies like Monsanto are attempting to create a monopoly on food crops. Any such patents have the potential to hasten and worsen a food crisis and have already made countless numbers of farmers so dependent on big Agribusiness that their lives and livelihoods have been destroyed by debt. Patents on pathogens, DNA, or other organisms have a huge potential for abuse. Legislation to prevent the patenting of life is critical for the preservation of national and international security and for bringing a hault to the sharp decline in crop biodiversity that threatens our survival as a species.

Make it illegal to patent living things. It is not only unethical but also potentially dangerous for us all. There should be no patents on seeds or plant varieties, strains of bacteria or viruses, DNA, or any genetically modified organism.

    This is a VERY complex issue that should be integrated into FDA reform.

    The existing panels address safety and efficacy of drugs, but this needs to be expanded.

    Expanded understanding of the genetics of humans, animals, plants, and micro-organisms as well as refined understanding of the metabolism within cells and organisms calls for a new balance while stimulating further innovation.

    We want to continue to encourage investigation while maintaining oversight such that the process is integrated and reflects social responsibility.

    There are skilled individuals who understand the nanotechnology issues related to this already working at the FDA.

    We don't want more bureaucracy and Federal costs.

    A rather radical suggestion might be to tax heavily pharmaceuticals advertising and divert those funds into a fresh free-enterprise coalition with government that truly advances innovation.

Monsanto adds foreign DNA by the shotgun method of coating very fine metallic slivers with foreign DNA and shooting it into the seed that has been soaked in an enabler formula. The seed that germinates and does not overtly show bad mutations is the seed they foster onto the world.

    • Round Up Ready modified corn is a corn that is resistant to a direct spray of Monsanto’s Round Up herbicide (glyphosate). This allows farmers to spray entire fields with Round Up to control weeds. Round Up was once packaged with the label of biodegradable, but since had to remove this as it was untrue. I do no know if or how long it takes for Round Up to break down or whether the broken down components of Round Up are harmful to people and the environment. I do know that DDT that was once approved as a pesticide was not harmful in its unbroken form, but once light broke it down into component parts it became highly toxic and a deadly carcinogen. DDT was not water soluble and it bonded to fat, which means it is still in those fields where it was used forty years ago.

    • Break Monsanto’s patents on seed bank genomes. Monsanto raided many seed banks and took seed samples, had those genomes genetically mapped, and then patented them all. Monsanto didn’t invent these genomes; they only had them genetically assessed. No rights of ownership should be given to this company for seed varieties held by seed banks.

    • Ban Terminator seed technology. Terminator is a new seed design that only grows if a special coating or fertilizer is used. Grains produced from terminator variants are sterile. Corn is fertilized by wind blown pollen from the tassels. Pollen can cross species from other fields by this act. Genetic drift from terminator strains will sterilize the genomes of other genetic variants. The reason for creating this sterile seed program is to lock in their profits. Each season farmers will have to come to Monsanto to buy seeds, they will not risk the potential of other seed types since they may be contaminated with terminator. If the farmer saves seed from prior year’s harvest it could be infected with terminator and once planted, may show voids in the field were seed never germinated. Once this genie is released in the genetic winds, it will become unstoppable.

    • Ban “rbGH and rbST hormones used in increasing milk production in cows. These chemicals are injected in cows every two weeks in mega doses. These artificial hormones are very similar to human growth hormones and do leach into the milk, especially the few days after the biweekly mega dose of hormones. Pasteurization does not remove or destroy any of these growth hormones. Milk products from producers that use these hormones must be separated from those who do not and labeled as such. Iowa used to have the best milk in the industry, not anymore. These hormones do affect the flavor of the milk. I was in Hawaii for a few months and their diaries do not use artificial growth hormones and their packaging labels say this “No Artificial Growth Hormones”, also the milk tastes great. Cows who are injected with these hormones often suffer from udder diseases, which increase the needs to inject them with an antibiotic, which also leeches into the milk. Currently milk produced in Iowa carries the label, “No Artificial Growth Hormones Added” or “No Hormones Added” this is an intentional mislabeling of a product, since no where in the world does any dairy add growth hormones to the milk, they add it to the cows that produces the milk.

I FOUND IT FASCINATING THAT THE ONLY PEOPLE WHO APPLAUDED MY DISPLEASURE WITH THE HUMAN GENOME PATENT TO BE FROM EUROPE. I GUESS THEY UNDERSTAND THE CONCEPT OF THE DNA IS MINE CAUSE ITS IN MY BODY, THAN US PATENT ATTORNEYS. FUNNY.

    I note an excellent review entitled NAVIGATING THE MOLECULAR DIAGNOSTIC PATENT LANDSCAPE from Dianne.Nicol in Expert Opinion on Therapeutic Patents

    May 2008, Vol. 18,#5, pp 461-472 in which the author concludes that, "While enforcement of relevant patents against public-sector organizations appear to somewhat less frquently encountered than might be expected. private organizations are likely to be exposed to far more such actions. It is argued that these organizations should consider more cooperative licensing strategies outside the more traditional exclusive-rights model."

    Discussion at this level may guide us to a cooperative interface of disciplines such that our actions regarding the FDA will be of global positive impact.

  7. some laundry detergent companies use genetically engeneered bacteria to make "stain removing" enzymes-should they not be able to patent bacteria that they have specially engeneered for this process??

  8. In all the cases I have heard, patents reduce competition. This is the real reason that industries want them. The fashion industry does not have patents or copyright and it is one of the most competitive industries out there.

    Developing the technology is expensive and its own deterrent.

    The answer to your question.... NO! They should not be able to patent bacteria. It's life. They are not even using it be better humanity or the quality of life. They are using it pure for lucrative purposes and to monopolize and industry. It's just ethically and morally wrong. No corporation should be able to patent life at any stage.
