Making Government Operations More Open »

Make all illegal acts unclassified

Why Is This Idea Important?: When government officials can act illegally and face no feasible prospect of prosecution, we have tyranny — a government of men, not laws. Currently government officials can do this merely by classifying illegal acts and policies. For example, the Bush administration explicitly threatened to prosecute the New York Times for publishing articles about the government spying illegally on its own citizens, a threat that made the paper hesitate to publish. Also, Bush administration memoranda on illegal torture policies took years to surface, finally forced out by the Obama administration's compliance with a court order. Secret "law" destroys freedom. When the government has the power to break laws, the consent of the governed is broken.

We propose a law that automatically makes unclassified any evidence of illegal government action or policy.

Any person who publicly reveals classified information, information that the person can show evidences illegal government action/policy, shall be exempt from prosecution under laws pertaining to classified information.
